Re: //Dil Se Desi// 2G conspiracy: CBI should probe culpability of beneficiaries -- SC

Who's going to probe CBI for their failure in lots of issues?
Bofors issue, Talwar murder, Hassan Ali case, etc. where CBI has botched the enquiry or let the criminals go scotfree

The court observed, "There are many who feel they are above the law...the law must catch them and be expeditious."

Set up special court for 2G scam: SC to govt

AGENCIES, Feb 10, 2011, 03.53pm IST
NEW DELHI: The Supreme Court on Thursday asked the government to constitute a special court exclusively for dealing with  2G spectrum case.

The CBI will file the first chargesheet in 2G spectrum scam against former telecom minister A Raja and others under Prevention of Corruption Act (PCA) for cheating and forgery by March 31, the Supreme Court was told.

The apex court said it favours a CBI probe that also covers culpability of beneficiaries of the scam as they are part of larger conspiracy. The court added that the agency must have a free hand to question anyone.

"It appears that their freedom is curtailed as it is seeking short remand of the accused," the court said.

"We have large number of persons who think themselves to be the law. Law must catch them. Merely their being in the list of Forbes or millionaires does not make difference," the Supreme Court added.

The Supreme Court on Thursday sought the central government's response on its suggestion to set up a special court to exclusively carry out the trial in the 2G spectrum scam case.
"Our endeavour is that the case is taken to its logical conclusion and is not frustrated by some technical endeavours," said the apex court bench of Justice G.S Singhvi and Justice Asokh Kumar Ganguly.
The court also directed that no court in the country except for the Supreme Court will interfere in the investigation by the Central Bureau of Investigation (CBI) in the 2G scam.
The court asked the CBI to carry out an investigation to find who were the beneficiaries of the larger conspiracy in the 2G scam.
The apex court considered the status report filed by the investigating agency in a sealed cover.
The CBI told the court that it will file a chargesheet for the 2G scam March 31 and for the question of larger investigation spanning from 2001-2006, the chargesheet will be filed on May 31, 2011.
The matter will come up for hearing March 1 when the Attorney General G. Vahanvati will inform the court about government's response to the suggestion to set up a special court to try 2G scam case.

Shahid Balwa link to 2G spectrum money trail

The 2G trail is now leading to the door step of Tamil Nadu Chief Minister karunanidhi - courtesy Shahid Balwa - a director with DB realty.
Balwa had earlier been named by Forbes as the youngest in the list of India's richest and is now in CBI custody.
Shahid Balwa till last year was on the Forbes India list for being the youngest of the 100 richest Indians. Now the law has caught up with him for his alleged links with the DMK and across the border.
CNN IBN has joined the dots of the Rs 214 crore money trail that was allegedly used as kickbacks in the 2G scam.
The money is reflected in kalaignar tv's balance sheet as an unsecured loan which came from Cineyug Media, who in turn got this loan from Kusegaon Fruit and Vegetables. Shahid Balwa has a stake in each of these companies.
Telecom operator Etisalat DB where Balwa is a promoter is also in trouble for other reasons. CNN IBN has documents that prove the Dubai based company's FIPB clearance was rejected not once but four times, most recently in September last year with objections coming from the Union Home ministry.
For the first time in the context of an Indian working in an Indian company, the ministry said Balwa should not be associated with Etisalat DB in any capacity. The home ministry suspected that the FIPB request was an excuse for round-tripping funds by the company's other partner Genex Exim. Other concerns included Etisalat's operations in Afganisation and Pakistan and its tie-up with Chinese firm Huawei.
Balwa's real estate business, which is also under the scanner, allegedly got support from a top Maharashtra politician. Questions are being raised about the BMC giving clearances to Balwa's five star project in double-quick time. Balwa's take-over of Hotel Centaur Lakeview in Jammu & Kashmir has also run into trouble.
From controversial land deals to hotel takeovers to telecom operations, Shahid Balwa did not reach where he did without support across the political spectrum. And while the DMK has run into trouble courtesy Balwa, the question is will the CBI probe his other links as well or will it go this far and no further.
